Terms and Conditions for Registering for the Personal E-Wallet Service with AlawnehPay
Whereas the service provider is a company licensed by the central bank of Jordan as a payment services provider, in accordance with the provisions of the Electronic Money Transfer and Payment System No. (111) for the year 2017 and the instructions issued thereunder for managing and executing credit and debit electronic payment transactions, which include mobile phone payments, issuing and managing payment instruments (excluding debit instruments), and providing electronic money collection services in the Hashemite Kingdom of Jordan, and since the undersigned client wishes to contract with the service provider for the purpose of opening an electronic wallet and benefiting from payment services through the electronic wallet in accordance with the terms and conditions of those services.

Electronic Money
Monetary values stored electronically, magnetically, or by any other means represent an obligation to their issuer. They are issued in exchange for receiving their monetary value for the purpose of executing payment transactions and are accepted by persons other than the issuer.
Agent
The entity to which the service provider delegates the performance of some or all
the tasks it is licensed to carry out, using the tools or systems operated by the payment services provider.
Client
The natural or legal person registered in the national database through the service provider is the owner of the electronic wallet for the purpose of using payment services.
Personal Data
All data pertaining to the client, regardless of its source or form, through which the client’s identity can be directly or indirectly determined, or through which any of their transactions can be identified, except for information available and known to the general public
Electronic Wallet
It is the virtual account opened by the company in the name of the client to enable them to carry out payment transactions via mobile phone.
Card
The AlawnehPay Debit Card associated with the electronic wallet.
- The Introduction and definitions are considered an integral part of this agreement.
- The applicant must be at least 18 years old. Those under 18 must apply through their legal guardian (parent/guardian) or legal representative
- The client authorizes the service provider to submit their data to the national switch for registration purposes. The service provider commits to sending the registration result to the client.
- The client unconditionally authorizes the service provider, without revocation, to record any transaction carried out on the client’s wallet account with the service provider.
- Upon the client’s official registration and service activation, the service provider issues a user code and personal identification number (PIN) to the client. The client is responsible for maintaining and safeguarding it entirely.
- The user code and personal identification number received by the client serves as acknowledgment by the client of their consent to execute any requests, services, or orders.
- Mobile phone payment service is provided exclusively within the Hashemite Kingdom of Jordan and in Jordanian Dinars only.
- Financial transactions permitted for the client through the wallet include but are not limited to: money transfers, bill payments, merchant payments, card transactions (withdrawals and deposits) via ATMs or agents (companies, merchants, personal clients).
Client Responsibilities
- The client acknowledges that all data, information, and documents provided by them are accurate and in accordance with the law. They accept full responsibility for the accuracy, legality, and any related matters.
- The client acknowledges understanding the operating mechanisms of the services and any published instructional information and agrees to review them.
- The client agrees to abide by the mobile phone payment instructions, the operational framework, and instructions issued by the Central Bank of Jordan regarding this matter and any amendments thereto.
- The client acknowledges that they are the true beneficiary and owner of the electronic funds available in the electronic wallet account, subject to legal responsibility.
- The client acknowledges receiving all secret numbers related to the electronic wallet and/or card without the need for their signature upon receipt.
- The client agrees that all electronic service records of the service provider are authentic, documented, and binding upon them. They also agree to consider the electronic record preserved and extracted from the national switch, covering all transactions and operations carried out through the national switch, as the authorized electronic record in case of any dispute.
- The client acknowledges that the service will be provided in Jordanian Dinar currency only until legislative approval states otherwise.
- The client agrees to unconditionally authorize the service provider to record any transaction carried out on the client’s wallet account with the company.
- The client acknowledges that the use of the service is subject to the prevailing legislation issued by the Central Bank of Jordan.
- The client acknowledges that the use of the service is subject to the prevailing legislation issued by the Central Bank of Jordan and must use the service in a lawful manner that does not contradict the purpose of this contract. Failure to comply may result in legal action, including contract termination and compensation claims against the service provider.
- The client acknowledges and agrees that the service provider reserves the right to modify the terms and conditions at any time after notifying the client in a suitable manner, which may include, but is not limited to, publication on the service provider’s website, publications, newspapers, and text messages, without stating the reasons. The client also agrees to abide by these terms and conditions after any modifications and agrees that using this service/services after any amendments or changes to its terms and conditions constitutes acceptance and approval of all new and/or amended terms and conditions.
- The client acknowledges their awareness and personal agreement that their subscription is linked to their national number for Jordanians, or the establishment’s national number for private/public companies, or an accepted identity document number according to prevailing regulations for non-Jordanians, and in accordance with anti-money laundering and counter-terrorism financing regulations.
- The client acknowledges and agrees that the service provider has the right to immediately cancel and/or close the electronic wallet and/or card upon request from security authorities and/or the Central Bank of Jordan, without notifying the client.
- The client commits to funding the electronic wallet and maintaining a sufficient balance for the purpose of using the electronic wallet. It is not permissible to use balance top-up cards for mobile phones to fund electronic wallet balances.
- The client acknowledges that the electronic wallet is linked to the mobile phone number provided/selected by them. Payments are made through the electronic funds transferred by the service provider/agent to the client’s wallet in exchange for the received cash amounts, which are then handled by the client.
- The client acknowledges having reviewed the daily and monthly transaction limits for mobile phone payments as specified in the instructions issued by the system administrator and any amendments that may occur.
- The client commits to adhering to the daily transaction limit as stipulated in the instructions issued by the service provider and any amendments that may occur.
- The client is responsible for promptly informing the service provider of any loss or change in the registered mobile phone number through the customer service available 24/7.
- The client must send any complaints to the company’s complaints center and/or call the complaints center’s dedicated number available 24/7.
- The client acknowledges that if they link their mobile phone number with their account, their data will be displayed to the transfer originator on the payment channels of the participants in the system.
- The client agrees in advance to disclose their personal data (name and/or account number and/or service provider name) to the transfer originator on the payment channels of the participants in the system when performing any financial transfer, receipt, or inquiry.
- The client must send any suggestions to the customer service center of the service provider and/or call the customer service center’s dedicated number available 24/7.
- The client is personally responsible for verifying the transaction details, including the recipient’s phone number and the amount, before executing the transaction, ensuring the protection of the personal secret code, adhering to all security and confidentiality rules as stipulated by the service provider, and refraining from issuing transactions without sufficient balances in their accounts.
- The client acknowledges and agrees that the service provider reserves the right to modify the terms and conditions related to this service at any time after notifying them of this action at the provided address and through all available means, stating the reasons. The client also agrees to abide by these terms and conditions after any modifications and agrees that using this service/services after any amendments or changes to its terms and conditions constitutes acceptance and approval of all new and/or amended terms and conditions.
- The client undertakes to verify the transactions they have made by accessing the service provider’s app or contacting customer service.
- The client is responsible for verifying all transaction details before executing them. The client acknowledges that the service provider is not liable for any errors, omissions, or negligence on the part of the client and will not be responsible for any damages, expenses, or claims resulting from them.
- The client is responsible for protecting and ensuring the confidentiality of their personal secret code, adhering to all security rules as stipulated by the service provider. The client acknowledges that the company/service provider is not liable for any errors, omissions, or negligence on the part of the client and will not be responsible for any damages, expenses, or claims resulting from them.
- The client has the right to submit suggestions or lodge complaints without incurring any additional fees or commissions that may hinder their right to file a complaint.
- In the event of the client’s death, the funds in the electronic wallet will be frozen, and the freeze will only be lifted after fulfilling all legal requirements according to the applicable laws in the Hashemite Kingdom of Jordan.
- The electronic wallet will be considered dormant if no debit transactions have been made for one year. In case of failure to communicate with the client who owns the wallet and exhausting all means of contacting them, a fee will be charged according to the pricing policy published on the service provider’s website.
- The service provider is obliged to notify the client at their available address that their electronic wallet will be considered dormant at least one month before the expiry of the aforementioned period.
- No withdrawal or transfer transactions from the dormant electronic wallet will be accepted except by the client personally or by their authorized legal representative through a notarized power of attorney or an authorized signatory in the case of a legal entity, by visiting the payment service provider at its main office.
- If the client or their legal representative visits the service provider to reactivate the dormant electronic wallet or withdraw the balance, the service provider is committed to reactivating the electronic wallet or disbursing the remaining balance.
- The client acknowledges that the service provider has the authority to cancel the dormant wallet if its balance is zero without obtaining their consent. The service provider will notify the client of the wallet’s cancellation via the phone number associated with the wallet registered with the service provider.
- The client acknowledges that, after being informed, if any reason is found, or if the client breaches the contract terms, or if any of the documents provided are found to be incorrect, or if the client is listed on any of the sanctions lists issued by the UN Security Council in addition to the national list issued by the Technical Committee for Implementing the Obligations under UN Security Council Resolution 1373 (2001) and other related resolutions, or if the client engages in unlawful activities, the payment service provider may terminate the contract after notifying the client in writing or electronically at the designated address and suspend and/or terminate the provision of the service at any time without incurring any legal or contractual liability in any form.
- The client agrees not to deal with any of the countries prohibited from dealing with, and the service provider reserves the right to reject any transactions related to economic sanctions and bans imposed or to be imposed on countries, entities, or individuals.
- The client waives the banking secrecy and authorizes the service provider to disclose any information requested by domestic or foreign authorities or required by the nature of the operations and services provided by the service provider and/or requested by the client. The client also authorizes the service provider to exchange information with Jordanian official authorities or, if required by international and local anti-money laundering and counter-terrorism financing laws/instructions.
- The client agrees to the procedures and systems used by the service provider to authenticate electronic services and process information, which aim to prove the accuracy of the information and attribute it to the client, including their electronic signature. The client also agrees to the service provider’s adoption of any licensed entity or entity will be licensed for the purposes of authentication, identification, and verification of the client’s identity.
- The client agrees to conduct and execute electronic services electronically, and the client also agrees that the provisions of the Jordanian Electronic Transactions Law shall apply and any amendments thereto.
- The client absolutely acknowledges that all types of electronic transactions related to electronic services are valid and acceptable as evidence and are not subject to challenge in any way, and therefore, the client waives their right to challenge them in the future or claim their invalidity definitively, with the understanding that electronic transactions, as defined in the Electronic Transactions Law, include, but are not limited to, data, texts, images, shapes, sounds, symbols, databases, computer programs, as well as the process of exchanging electronic data, including fax, telex, and email.
- The client bears any errors that may arise from mistakenly depositing and/or transferring any amount from their electronic wallet account to another account and acknowledges that the service provider is not responsible for any errors, omissions, or negligence on the part of the client, and will not be liable for any damages, expenses, or claims resulting from them.
- The client acknowledges and agrees that the service provider will not be liable for any errors, damages, or expenses that may be incurred as a result of any breach of these terms and conditions by the client. Furthermore, the client undertakes and agrees to indemnify the service provider for any compensation claims and damages resulting from any breach of these terms and conditions by the client.
- AlawnehPay Card will be issued to the client upon their request, subject to the terms and conditions of the service provider, while considering the laws, regulations, and instructions. The client is responsible for any transactions carried out with the card, including the safeguarding of the card and PIN, and any loss incurred by the service provider as a result of the misuse of the card and/or electronic wallet and/or the device used.
- The client acknowledges that the card is the property of the service provider and is handed over to the client for their personal use. It is non-transferable, and the client undertakes to keep it and retain possession of it throughout its validity period, and not to hand it over to another person.
- The client agrees to the validity of the financial transactions executed on any of their cards and considers all records of the service provider as authentic and documented for them. The client also agrees to consider the electronic record stored and extracted from the service provider’s systems as the approved electronic record in case of any dispute, and releases the service provider from any responsibility regarding these transactions.
- The client agrees to the maximum and minimum daily/weekly/monthly transaction limits as determined solely by the service provide, and may be subsequently adjusted either upwards or downwards without the need for prior notice to the client.
Responsibilities of the Service Provider
- The service provider undertakes to inform the client of the registration status in the electronic wallet.
- The service provider undertakes to inform the client of their wallet balance, the type of transaction executed, and the remaining balance in the wallet immediately after any transaction is completed.
- The service provider undertakes to refund amounts to client in case the service provider ceases to provide the service in accordance with the procedures of the service provider.
- The service provider undertakes to take all necessary measures and precautions to ensure the security and confidentiality of client information.
- The service provider undertakes to take all necessary measures to ensure that the service complies with all applicable laws in the Kingdom and any instructions issued by the Central Bank of Jordan, and to comply with the requirements of anti-money laundering and counter-terrorism financing.
- The service provider undertakes to provide the client with a list of commissions, fees, and interest payable by the payment service provider for all products and services provided by the company, as stated in the commissions tab and commission ceilings on the website.
- The service provider undertakes to inform the client of any sudden system failure through the approved communication channels.
- The service provider undertakes to take all necessary measures and precautions to ensure the security and confidentiality of client information.
- The service provider undertakes to provide the appropriate environment and security measures to protect data and take precautions to ensure the security and confidentiality of client information.
- The service provider undertakes to protect personal data, whether electronic or physical, from loss, damage, alteration, disclosure, theft, tampering, unauthorized access, or use, whether incidental or unauthorized.
- The service provider undertakes to inform client through appropriate and available channels of any changes that may occur to the list of commissions and fees that affect client, at least 30 days before the application of the new prices and commissions.
- The service provider undertakes to accept any suggestions or complaints from client without imposing any additional fees or conditions that may hinder their right to lodge a complaint.
- The service provider undertakes to follow special procedures in these cases (death of the client, freezing of the wallet, closing the electronic payment account, or suspending any of the payment tools or electronic means associated with it).
- The service provider undertakes to clarify or inform the client about the financial transactions they are allowed to perform, as stated in the general terms and conditions tab on the website.
- The service provider undertakes to provide the client with any notices, data, or statements related to their electronic wallet, even if there is a legal dispute between the client and the service provider.
- The client agrees that the service provider is not responsible if the card is not accepted by others. Additionally, any dispute between the client and others does not affect the rights of the service provider towards the client in settling the obligations arising from the use of the card and/or related to it. Furthermore, the service provider is not responsible for any defects or deficiencies in the goods and/or services obtained by the client through their use of the card.
Commission
- The service provider charges the client a commission for each transaction carried out by the client when using mobile payment services, as specified and published on the service provider’s website or through the mobile application. The service provider undertakes to provide the client with a copy of these commissions and inform them of any changes to the commissions by available means.
- The client acknowledges and agrees that the service provider reserves the right to modify the pricing, fees, and commissions related to this service at any time after notifying the client in a manner deemed appropriate by the service provider, including but not limited to (publishing it on the service provider’s website, publications, social media sites, text messages) without stating reasons. The client agrees to abide by these fees and commissions after they have been modified and agrees that by using the service(s) after any modifications or changes to the pricing, fees, and commissions, they accept and agree to them.
Legal Responsibilities
- The client authorizes the service provider irrevocably and non-negotiable to reverse any charge made to the client’s wallet or card due to an error, whether technical or human, or through electronic piracy, and releases the service provider from any liability arising from this type of errors or negligence.
- The client undertakes, upon discovering any error, to immediately inform the service provider and to refund any amounts withdrawn by the client from the account mistakenly upon becoming aware of it, and/or upon the first request from the service provider, without any objection from the client.
- The client bears legal responsibility if they exploit any errors or tamper with the system for their benefit, while respecting the laws and regulations governing this.
Final Provisions
- It is agreed between the parties that the service provider has the right to terminate this contract immediately if the service provider is unable to take due care of the beneficiary, or if the client violates the terms and conditions of the contract, or if it is found that any of the documents submitted are invalid, or if requested by the Central Bank of Jordan, administrative, security, or judicial authorities, or if it is discovered that the client is listed on any of the blacklists issued by the United Nations Security Council or the national list issued by the Technical Committee to implement the obligations contained in Security Council Resolution 1373 (2001) and other related resolutions, or if the client engages in unlawful activities.
- It is agreed between the parties that the service provider has the right to suspend the service and/or the electronic wallet and/or the card immediately without any liability on the part of the service provider if the client’s name appears on the blacklist of the Central Bank and/or if requested by any security or official entity without notifying the client.
- The Client agrees to consider the address provided by them in the contract as their chosen domicile for all matters related to this contract, whether for notification, communication, and to consider the phone number provided in the contract as the official means of communication and notification for all matters related to this contract. The provided email address shall be considered valid, and any notification sent to the address, phone number, and email address shall be legally effective without any liability on Alawneh for Electronic Payment Services.
- The Client agrees that this contract is governed and interpreted according to the laws and regulations of the Hashemite Kingdom of Jordan, and the parties acknowledge that the courts of Amman are competent to adjudicate any dispute related to these terms, conditions, and services.
- The client has the right to submit complaints by contacting the number 06/5509292 ext. 300 or through the website and through all available means, and if a solution to the problem is not reached within 30 working days, or if there is no satisfactory response from the service provider, or if the service provider refuses to accept the complaint, please contact the Central Bank of Jordan, Financial Consumer Protection Department at 06/4630301 or resort to legal action.
I agree to deal with you by mobile phone payment and acknowledge my responsibility for the accuracy of the above information in accordance with the principles and conditions of the mobile phone payment service. I also agree to the terms and conditions attached to this form, which are an integral part of it and are read together as one unit. By signing/electronically agreeing to this form, I agree to contract with Alawneh for Electronic Payment Services for mobile phone payment services.
